Bankruptcy assistance

Facilitated owner (debtor in possession) in all matters involving negotiation with lender on foreclosure proceeding on a 302 unit apartment property. Negotiated DPO loan acquisition and identified capital from a third party leading to financial restructuring favorable to the owner and satisfactory to the lender. Property was recapitalized leading to eventual sale on conventional terms. Original equity stake was preserved and the project achieved a return in line with what equity should expect at the time of sale.

Obtaining entitlements

Negotiated water allocations from Hawaii County Department of Water Services for a single family project located in a remote area of the Big Island.  Anticipating the need for affordable housing, the Hawaii County Planning Department and other necessary agencies agreed on terms viable for the developer as well as Island community resulting in satisfied parties on all sides.  Agreement on these terms allowed a stalled development to move forward.  Value for these services can only be measured when the eventual sales are tallied.

Development restructuring​​

Facilitated EB5 single family home development in a high barrier to entry market with project specific environmental challenges. Provided development services and put together a team of civil, geotech, environmental, vertical construction contractors as well as sales and marketing team to position the project for bulk sale or development. Ultimately procured financing for the owners to move forward with the project and develop. 2X invested amount earned.

Maximize donative value

Facilitated assemblage of 4,000 acres of land and surface rights located along the Gulf Coast for doner land contribution to qualified 501C3 and direct sale. Most of the land was donated and part of the land was sold to various interested parties looking to take advantage of their own protected portfolios. Ducks Unlimited and Hilcorp Energy were amongst the transacting parties. 4X invested amount earned.

Agency collaboration

Facilitated the assemblage of three contiguous land parcels bordering a superfund site as well as a river with more than one mile of waterfront. Agency acknowledgments were obtained to assure the environmental quality of the existing properties. To create value, we separated mineral rights, created easements and assayed for sand mining purposes for use in fracking. Recognition of uses also included barge fleeting, dredging spoils placement and sand mining. Current ownership has the flexibility to sell or lease in multiple parcels for multiple uses. 4X invested amount earned.

Financial restructuring

Arranged for additional capital from mezzanine to complete DPO on 297 unit apartment complex. Final negotiations were successful in preserving an interest in the property for existing equity interests while the mezzanine lender advanced in the capital stack securing its interest. Property was recapitalized leading to eventual sale on conventional terms.

The additional mezzanine investment achieved a market return in line with the first secured position. 2X invested amount earned.

Regulatory remediation

Facilitated owner in permitting and environmental processes leading to master planned community or multifamily, single family, industrial, flex and retail users. Provided development services and put together a team of civil, geotech, environmental and legal necessary to carry the master plan development forward and provide a streamlined communication platform for all developers and interested parties. Impact Residential Housing (Starwood) and LINCOLN Avenue Capital (Bronfman family) as well as Medline, Inc. are actively pursuing current development. 2X invested amount earned.
